The Takeovers Panel has been served with a Federal Court application dated 5 April 2011 for judicial review of its declaration of unacceptable circumstances and orders in the matter of CMI Limited [2011] ATP 4 (the Application). Peter Day, John Keeves and Andrew Sisson in their capacity as members of the Takeovers Panel, who presided over the initial Panel's proceedings, are named as the respondents.

The Panel has made a declaration of unacceptable circumstances (Annexure A) and final orders (Annexure B) in relation to an application dated 21 March 2011 by BC Iron Limited (BCI) in relation to its affairs.

The Panel has received an application from BC Iron Limited in relation to its affairs.

On 15 March 2011, the review Panel declined to conduct proceedings on a review application received on 24 February 2011 from Tinkerbell Enterprises Pty Ltd and Ms Leanne Catelan in relation to the affairs of CMI Ltd (see TP21/11).

The Takeovers Panel welcomes the recent announcement by the Parliamentary Secretary to the Treasurer of the reappointment of 11 members and the appointment of 6 new members to the Panel, for terms of 3 years commencing on 8 March 2011.

The Panel has declined to conduct proceedings on a review application received on 24 February 2011 from Tinkerbell Enterprises Pty Ltd and Ms Leanne Catelan in relation to the affairs of CMI Ltd. 

The Takeovers Panel advises that it has consented to the request of Alinta Energy Limited and Alinta Energy Services Limited as responsible entity for Alinta Energy Trust (Applicants) to withdraw an application to the Panel dated 7 March 2011.  The application related to the affairs of Alinta Energy Limited and Alinta Energy Trust (Alinta Energy).

The Panel today published the reasons for its decision on an application dated 6 January 2011 from Mr Gerry Pauley and Dr Gordon Elkington in relation to the affairs of CMI Limited.
